By using MapCenter you agree to the following

0. Definitions

IN THESE TERMS AND CONDITIONS “MAPCENTER” REFERS TO THE WHOLE MAPCENTER'S WEB SERVICE AND OTHER SERVICES PROVIDED BY MAPCENTER AND ITS STAFF.

“USER” REFERS TO ANY USER WHICH DOWNLOADS DATA AVAILABLE AT MAPCENTER,

“AUTHOR” REFERS TO ANY REGISTERED USER WHO UPLOADS HIS OR HER DATA TO MAPCENTER.

“MAP” REFERS TO ANY MAP UPLOADED AND AVAILABLE FOR DOWNLOAD FROM MAPCENTER.

“POLISH FORMAT” REFERS TO DATA FORMAT ACCEPTED BY CGPSMAPPER PROGRAM.

1. Acceptance of terms

By using MapCenter you accept the Terms and conditions of use. Do not use MapCenter if you do not agree with any of these Terms. MapCenter authors provide the service and all Maps to the User, conditioned upon the acceptance, without modification, of the Terms contained herein.

We reserve the right to change, modify, add or remove portions of these Terms at any time. Such modifications will take effect immediately after posting to MapCenter. If you continue to use MapCenter then, it means that you accept the changes.

2. NO UNLAFWUL OR PROHIBITED USE

By using MapCenter you guarantee that you will not use MapCenter or any content obtained from MapCenter for any purpose that is illegal or prohibited by these Terms. If you violate any of these Terms, your permission to use the MapCenter will automatically terminate.

3. Description of MapCenter web service

MapCenter web service is a website owned by GPS enthusiasts, with the purpose of creating and sharing maps compatible with Garmin GPS receivers. We are offering space on our website for sharing maps with all Users.

MapCenter currently offers free access to cgpsmapper Std version program (as described at http://gps.chrisb.org/) for all Authors and allows to convert Polish Format data to Map format. MapCenter does not provide any support on using the cgpsmapper Std version program - this program is provided “as is”.

The author of cgpsmapper program does not provide any support to Users on using the program.

All content uploaded to the service automatically becomes available to all Users. It includes all data available in Polish Format and all Maps in binary format which were created using the cgpsmapper program.

MapCenter's goal is to offer all Users a rich collection of Maps at no charge. Users may download, use, and modify Maps for free AT LEAST for private purposes. Authors may decide whether content of their uploads can be freely used and/or freely modified and distributed for purposes other than private. Authors agree that any content uploaded to MapCenter may be used for private purpose by any User.

Please note, that uploading new or modified Maps to MapCenter for compilation is equivallent to distributing this Map and may be performed only by map's Author or in accordance with Map's license.

4. Registration obligations

Each user must provide true, accurate, current and complete information when filling-in the Author registration form, and maintain and promptly update the registration data if necessary. If, after investigation, there would be reasonable grounds to suspect that the User's information is untrue, inaccurate, not current or incomplete, the User's account may be suspended or terminated and the User may be prohibited of any and all current and future use of MapCenter.

Each Author will receive a password and account designation after completing MapCenter registration process and is wholly responsible for maintaining the confidentiality and liable for all activities associated with his account.

5. Maps and other content

All information, whether publicly posted on or privately transmitted via MapCenter, are the sole responsibility of the person from which such content originated. This means that Authors themselves - not MapCenter - are entirely responsible for all content that is uploaded or otherwise transmited to MapCenter. Noone should transmit content or participate in any activity on MapCenter which, according to MapCenter staff is likely to be prohibited by law in any applicable jurisdiction, including the permissible uses of intellectual property, copyrighted maps data, data from illegal sources or data obtained from 3rd party sources.

Not all available content will be reviewed. However, Map Center staff reserve the right to block or delete any content reasonably considered to violate the these Terms or be otherwise illegal.

MapCenter staff reserve the right to block Author's access to the MapCenter if he is suspected of publishing any data in violation of the Terms or being otherwise illegal.

6. Termination

An Author's account may be terminated in absolute discretion and for any reason. Especially, for reasons that include, but are not limited to, the following: 1.) violation of these Terms; 2.) abuse of site resources or attempt to gain unauthorized entry to the site or site resources; 3.) use of MapCenter in a manner inconsistent with the Terms; 4.) User's request for such termination; and 5.) requirement of applicable law or regulation.

Termination of any User's access to MapCenter may be effected without notice. On such termination, User's account may be immediately deactivated or deleted and/or further access to such files may be banned.

7. Disclaimer of warranties

EACH USER USES MAPCENTER AT HIS OWN RISK. MAPCENTER SERVICES ARE PROVIDED “AS IS” AND ON “AS AVAILABLE” BASIS. MAPCENTER OWNERS ASSUME NO RESPONSIBILITY FOR THE TIMELINESS, DELETION, MIS-DELIVERY OR FAILURE TO STORE ANY DATA.

EACH USER AND AUTHOR WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO HIS OR HER COMPUTER SYSTEM OR LOSS OF DATA. MAPCENTER IS NOT RESPONSIBLE FOR QUALITY AND CORRECTNESS OF ANY AVAILABLE DATA IN THE SERVICE. MOREOVER EACH MAPCENTER USER IS SOLELY RESPONSIBLE FOR ANY DAMAGE TO HIS OR HER GPS RECEIVERS POSSIBLY CAUSED BY ANY DATA DOWNLOADED FROM MAPCENTER. MAPCENTER CANNOT GIVE ANY GUARANTEE IN REGARD TO DATA COMPLETENESS, CORRECTNESS OR CURRENCY. MAPCENTER DOES NOT ACCEPT LIABILITY IN THE EVENT OF DIRECT OR INDIRECT CONSEQUENTIAL OR COLLATERAL DAMAGE RESULTING FROM THE USE, INCORRECT USE OR MISUSE OF THE MAPS.

MAPCENTER STAFF AND CGPSMAPPER AUTHOR DO NOT PROVIDE ANY SUPPORT FOR USING THE CGPSMAPPER PROGRAM AVAILABLE IN MAPCENTER SERVICE.
